Texas lawmakers are taking aim at THC — again.
This time, it’s Delta-8 THC and other hemp-derived compounds that are under fire. With less than two months left in the legislative session, two bills are making their way through the Capitol that could completely reshape the hemp landscape in Texas.

🌿 What’s Going On?
Lt. Gov. Dan Patrick is doubling down on his mission to ban Delta-8 THC across the state. The Texas Senate passed Senate Bill 3 in March, and now a companion bill — House Bill 28 — is under consideration by the House State Affairs Committee.
Let’s break down the two bills:

Senate Bill 3 (SB 3): Would completely ban hemp-derived THC products like Delta-8.

House Bill 28 (HB 28): Would introduce strict regulations, ban edibles and smokables, and only allow THC-infused drinks in liquor stores.
The House has yet to vote — both bills remain pending after this week’s testimony.
🤔 Why It Matters
In 2019, Texas legalized hemp products under the state’s Farm Bill, allowing the sale of low-THC cannabis compounds like Delta-8. Since then, Texans have turned to these products for:

PTSD care (especially among veterans)
Delta-8 offers a gentler psychoactive effect compared to traditional cannabis and is often paired with CBD for a balanced experience.
But now, with no clear evidence of harm, some lawmakers want to eliminate this access entirely. Patrick claims the industry is marketing to children and selling products with "unlimited THC" — though most retailers already follow age restrictions and testing protocols.
🗣 What Texans Are Saying
During public testimony, a majority of speakers opposed the ban. Many argued for regulation, not prohibition.
"Get those off the shelf. Regulate the hell out of this industry," said veteran advocate Mitch Fuller.
"In the veteran community, we've chosen this as an option in the toolbox that works for us."
Even House Speaker Dustin Burrows (R-Lubbock) admitted confusion:
"I'm all for small business, but I really don't know what's being sold. I have significant concerns."
